How are judges determined?

The California Legislature determines the number of judges in each court. Superior court judges serve six-year terms and are elected by county voters on a nonpartisan ballot at a general election. Vacancies are filled through appointment by the Governor.

What is the purpose of a judge?

They lead court proceedings, use established laws and guidance to determine sentencing, and rule on the constitutionality of various laws and legal precedents. We must ensure that anyone who serves as a judge is fair minded.

Who assigns cases to judges?

While for routine cases, there is a computer-devised coding system that lists cases, depending on the subject matter, to a particular bench, sensitive cases are assigned by the CJI to benches headed by senior most judges.

Do judges have final say?

The judge has no authority to set aside a verdict of not guilty on the ground that the evidence was sufficient to support a guilty verdict. A jury verdict of not guilty is final as to what the evidence shows. The jury is the final arbiter of the facts.

Can a judge yell?

Yelling at, swearing at, or just in general being rude to a judge is not a crime in and of itself. Not following a judge’s orders, however… The Judge will allow an emotional utterance, but you will then be warned.
