Is it illegal for your parents to not take you to the doctor?

Medical neglect is defined as a parent’s failure to provide adequate medical or dental care for their child, especially when it is needed to treat a serious physical injury or illness. Medical neglect is generally considered to be a form of child neglect, and is usually listed under a state’s child abuse laws.

Brian Parnell, a local program director for Child Protective Services, said doctors do contact CPS in such cases. “A doctor would be required to report that to us because there are instances where families neglect their child’s medical care,” he said.

Why do hospitals call CPS?

If the physician suspects that the injury is “non-accidental,” he or she must report it to the Child Protective Services (CPS. ) CPS will assess the report to determine whether it meets the legal definition of abuse or neglect if it does and how dangerous the situation is.

Why do parents refuse medical treatment for their child?

The expected outcome of that treatment is a relatively normal life with a reasonably good quality of life. The child would die without the treatment. The parent is refusing to grant consent for the treatment.

Yes, it’s called medical neglect. refusing to take your child to the doctor when and if they need to for (stitches, injuries, illnesses, dental issues, severe trauma or conditions such as asthma or diabetes) is classier as medical neglect! Anything wee like checkups is not ok to miss but not illegal!

What does it mean when CPS red flags you?

Investigations which automatically meet the Red Flag designation are those investigations in which, at a minimum, critical injuries have occurred, a permanent or serious impairment may have occurred, or there has been a death or critical injury to another child in the family.

What if parents disagree on medical treatment?

The first thing you should look at is your custody agreement. If it does not assign medical decision-making authority, see who has legal custody. In some cases, one parent will have legal custody of the child, giving them the final say on major healthcare decisions. But in most cases, parents share joint legal custody.

What do you do when your parents refuse medical care?

Try asking another family member or friend to reach out to your parent to express concern about the medical problem, encourage them to go to the doctor, and ask if they’d offer to take your parent to the doctor. If your parent is living in a senior community, there may be on-site nurses who can check in on them.
