What is CAA for Afghanistan?

The CAA, which came in to force in January last year, provides for citizenship for non-Muslim minorities from Muslim-majority countries such as Pakistan, Bangladesh and Afghanistan.

Why did India invest in Afghanistan? India had supported the anti-Taliban resistance when the Islamic fundamentalist group ruled Afghanistan between 1996 and 2001. After the collapse of the Taliban’s first government in 2001, New Delhi found an opportunity to increase its influence in the country.

Does India need a refugee law?

Even though the courts have upheld certain rights of refugees, there needs to be greater clarity about the protection they are entitled to. The time has, therefore, come for a national law specifying the rights and obligations of refugees and the state, and the procedure to be followed while handling refugees in India.

What is the CAA and why is it so controversial?

It fails to allow Shia, Balochi, and Ahmadiyya Muslims in Pakistan and Hazaras in Afghanistan who also face persecution, to apply for citizenship. A key argument by the critics against the CAA is that it will not extend to those persecuted in Myanmar and Sri Lanka, from where Rohingya Muslims and Tamils are staying in the country as refugees.

Does CAA have no link with NRC and NPR?

Karat also rejected the government’s claim that the CAA has no link with the NRC and NPR. CPI (M) leader Brinda Karat has asked why the Rohingya and Ahmadiyya Muslims, facing persecution in Myanmar and Pakistan, are not covered under the new citizenship law if the Centre is so much concerned about people facing atrocities in neighbouring countries.

Does CAA violate the Constitution?

At the first hearing on petitions challenging the CAA, the Supreme Court declined to stay the contentious law but asked the Centre to file its reply against the petitions that say it violates the Constitution. The petitioners say the Bill discriminates against Muslims and violates the right to equality enshrined in the Constitution.
