Does a DUI affect your nursing license in California?

A conviction of a DUI charge in the State of California is considered (at least) a misdemeanor; misdemeanor and felony (subsequent DUI’s may fall into this category) convictions must be reported to the nursing board. The results of being convicted with a DUI may include a revocation of one’s nursing license.

DUIs remain on your driving record with the Department of Motor Vehicles (DMV) for ten years. The ten-year-clock begins ticking the day of your arrest. After the ten years have expired, the DUI will no longer be held against you on your driving record.

The California Board of Registered Nursing requires RNs to disclose convictions, which includes a plea of guilty or no contest in criminal court, within 30 days from the date of court action. An RN should be on notice that the Nursing Board will be notified by the Department of Justice after arrest or a plea has been entered in criminal court.

Do I have to disclose a conviction when renewing my nursing license?

Nurses disclosing a conviction should allow extra time during the biannual nursing license renewal process. This is due to the fact that you must disclose if you were convicted of DUI and if your driver’s license was suspended. You may be required to submit additional supporting documentation along with your license renewal application.

Include your name, California RN license number, and a contact phone number. If you were licensed under a different name, please be sure to indicate your previous name (s). NOTE: The California Board does not participate in Nursys® license verification.
